Filing for Worker's Compensation? By: Dan Pritcherd
If you ever find yourself in the position of having to file a worker's compensation claim there are some things you will need to know about the process to file a successful request for workers compensation. The reasons for filing for compensation can be manifold. You can file for compensation if you have suffered any kind of loss while at work due to perhaps hazardous workplace conditions or potential neglect etc. For example, you could have been injured at work place or suffered some other loss for which you cannot hold any particular individual responsible. In such a situation, it is quite possible that your company cannot be held responsible for your loss if they have not directly violated the local, state, and federal labor laws. Therefore, to ascertain the guilty party it is very important to enumerate carefully the turn of events as they occurred while filling for compensation. A big part of any worker's compensation claim is the ability of all the parties to provide supporting records and documents that would support a claim of a injury or illness that required medical assistance. Workers compensation can be calculated and awarded to reflect the damage suffered due to the injury, the medical expenses incurred due to the injury, as well as other monetary awards for circumstances such as salary lost due to inability to work. If the individual or the parties requesting the worker's compensation claim can adequately present an argument for their side of the case, and the claim is thoroughly investigated and scrutinized, the individuals submitting the claim receive a large payment to compensate them from a loss of work or ability. The fact that there is much money to be made in the workers compensation world has caused a rise in fraudulent workers compensation claims. Some overly litigious individuals, or those who are of questionable integrity when it comes to their reporting of events that led to their so called "injuries", have many times taken advantage of the system that has been put in place to protect workers from potentially neglectful bosses and companies. Individuals who place fraudulent workers compensation claims, and are satisfactorily shown beyond a reasonable doubt to have done so in a court of law, will find themselves guilty of an offence that can come with a sentence that sometimes means years in prison for attempting to defraud their employers. Depending on the jurisdiction the offence is committed in, people who are found guilty of attempting to file a dishonest worker's compensation claim may be guilty of municipal, state, or federal laws. The punishment for this crime also varies from state to state, even county to county, but most jurisdictions will penalize convicted parties to the fullest extent of the law. Be sure to keep the most accurate possible documentation in any media form possible (photographs and video recording can make exceptional mediums to record actual physical damage that does not go away when the bruises heal). If you are considering filing a workers compensation claim be sure you cross every "t" and dot every "i". If you find that your case may be particularly difficult to prove you may wish to retain the services of a professional lawyer to assist you in your claim. Always remember, the important thing is to be as honest as possible while not letting your rights slip away from you if you have truly been a victim of a dangerous workplace or neglectful employers.
