Death sentence

Death sentence

Time has come when death sentence, where-ever it is compiled in statutory books, it should be abolished and we may introduce some other sentence in place of killing a man. We know that all those who are dealing with the condemned person are not happy and they are under pressure and frustration when they are carrying out the orders of the Court. Even the judge who is pronouncing death sentence, is not happy because, he is also not hundred per cent sure that this man had committed the crime for which he had been charged and which has been established against him.

There were times when this sentence was introduced in statutory books, but now after passing centuries, we are here to reconsider on this point. In all the religious books, we have been told that God sends us on this earth and He recalls us and we die. This concept is still available in religious books and none of the religions has declared that this concept is not correct nor this concept has been withdrawn. If the man on this earth is accepting this concept even today, then he should not keep such a law of hanging in the statutory books and this sentence must be written off from all the statutory books without any further delay.

The people who are the aggrieved parties must be consulted for conversion of this death sentence. If they are satisfied that this accused should remain in jail till he dies, it must be accepted and if they say that this man should be kept in jail for some time, that wish may also be accepted. If the aggrieved party wants some financial compensation, that wish of the aggrieved party may also be taken into consideration before passing final order. All such alternatives could be taken into account before finally deciding the fate of the condemned person. Death sentence should be abolished or these alternatives must be tried and if the life of the man could be saved, then we should decide accordingly.

We all know that only one person from the family has committed a crime and only he should suffer. But when the other members of the family are dependant upon this person who is condemned to death or life imprisonment, the remaining members of the family shall also suffer. The states could not find out a law under which these dependants could be saved from the sufferings which they shall face when their earning member or the bread winner is ousted from the house under the law and they are left unprotected. The state must consider this point and the man who goes to jail terms, his family should not suffer and the state must enact laws under which such families could get some relief from the state and save themselves from ruining.

Till alternatives are finalized, this principle of death sentence should be abolished or kept pending and none should be hanged in name of law of the land. This hanging and taking life of the person is like a sin, like a crime and like a misconduct. The people of the world must give opinion on this point and while deciding such things, they should keep in mind that so many states have already abolished this death sentence concept from their statutory books and they too are going on well.
